Proposed Constitutional Amendment to the United States

Section 1. Permanent Ineligibility for Citizenship Upon Criminal Charge
Any individual who is not a citizen of the United States and who is formally charged with any criminal offense under the laws of the United States, or any State thereof, shall be permanently ineligible for United States citizenship.
Section 2. Mandatory Deportation Upon Conviction
Any individual who is not a citizen of the United States and is convicted of any criminal offense shall be subject to immediate removal from the United States upon completion of any lawful detention necessary to carry out such removal.
Section 3. Reentry Restrictions for Non-Violent Misdemeanor Offenses
Any individual deported under this Amendment for a non-violent misdemeanor offense shall be denied reentry into the United States for a period of thirty (30) years from the date of removal.
Section 4. Permanent Inadmissibility for Non-Violent Felony Offenses
Any individual who is convicted of any non-violent felony offense under federal or state law shall be permanently barred from reentry into the United States for the duration of their lifetime.
Section 5. Permanent Inadmissibility for Violent Crimes and Conspiracies
Any individual who commits, is convicted of, or conspires to commit, aid, abet, or materially support a violent crime involving harm or intended harm to another person shall be permanently barred from reentry into the United States for the duration of their lifetime.
Section 6. Fraud Against Public Benefit Programs
Any individual who is convicted of fraud, attempted fraud, or conspiracy to commit fraud against any federal, state, or local public benefit program, including but not limited to welfare, healthcare assistance, housing assistance, disaster relief, or financial aid programs, shall be classified as having committed a felony offense under this Amendment and shall be permanently barred from reentry into the United States.
Section 7. Executive Exemption Authority
Exceptions to the provisions of this Amendment may be granted only upon:
- A case-by-case determination by the Secretary of State, and
- Formal approval by the President of the United States.
Section 8. Enforcement
Congress shall have the power to enforce and implement this Amendment through appropriate legislation, including the establishment of clear statutory definitions for violent crimes, non-violent misdemeanors, and non-violent felonies consistent with this Amendment.
Purpose and Intent
This Amendment establishes a uniform national standard governing the consequences of criminal conduct by non-citizens within the United States. It creates clear categorical distinctions between misdemeanor and felony offenses, as well as between violent and non-violent conduct, while ensuring that exploitation of public benefit systems is treated with the highest level of seriousness.
The Amendment is intended to reinforce the principle that entry into the United States carries a binding obligation to respect its laws, protect its people, and preserve the integrity of its public institutions.
